Dragging criminals out of politics

We were both happy and sad to hear of Thursday’s landmark ruling by the Indian Supreme Court which independent democracy analysts see as a major step towards cleaning up Indian politics which is beset by corruption and crime.

Happy, because the Supreme Court has helped India to take a giant leap towards a more vibrant democracy where a criminal cannot be a politician who does not serve but abuses his power and plunders the wealth of the country and the people.

We are sad because such a major step towards cleaning up the quality of politicians and politics cannot and will not be taken in Sri Lanka because the independence of the judiciary has virtually being destroyed specially after the illegal impeachment of Chief Justice 43, Shirani Bandaranayake.

The Indian SC known to be powerfully proactive in recent years regarding matters involving social justice, has ruled that members of the Lok Sabha and State Legislative Assembly members who are convicted of serious crimes will be removed from office.

It ruled that members of the Federal and Local Assemblies would be barred from elections if found guilty of offences carrying a jail term of at least two years. More than 150 members in the 543-seat lower house of the Lok Sabha are said to be facing criminal charges.

The Association for Democratic Reforms, an election watchdog, said across India there were 1,460 Lok Sabha or State Assembly members who were facing criminal charges. The figures were based on information provided by politicians to the Elections Commission before submitting themselves to the electorate. The figures show that 15 members face at least one murder charge.

Until now Indian politicians convicted of crimes had kept their jobs while pursuing appeals which can go on for years. But India’s SC ruled that such moves would no longer be allowed, striking down Section 8(4) of the Representation of the Peoples Act. The judges made clear that disqualification from office would take place from the date of conviction.

“If a convicted person has no right to vote, he has no right to contest,” Judges A.K. Patnaik and S.J. Mukhopadhyay ruled.

The judgment will not affect lawmakers who have already filed appeals – just those convicted in future. India’s main parties officially welcomed the ruling, but the government said it was studying it and might appeal.

While India is taking important steps in its democratic journey to development, Sri Lanka is plagued by a crisis of the criminalisation of politics and the politicisation of crimes.

In recent months specially, many chairmen and other members of local councils have been charged with horrific offences while in one of the worst cases a local council member had allegedly ordered a teacher to kneel before him and her students.

Corruption and crime in Sri Lankan society and politics are worst than ever before with the enforcement of the 18th Amendment, which provides the Executive President absolute power. With a patchwork coalition put together in parliament by offering perks and privileges to some parties, the ruling UPFA of the President has absolute power in the legislature also. With media fr eedom suppressed to a large extent, an independent judiciary was the last remaining hope for democracy and refuge for the people.

But with the government acting hard and fast to destroy the independence of the judiciary and with no sign of a turnaround in that dangerous trend, Sri Lanka seems to be reaching a point of no return on the path away from democracy and entering into the perilous pits of dictatorship.

Russia to help SL research on nuclear technology

Sri Lanka and Russia signed a bilateral agreement to obtain Russian assistance to develop and research on nuclear technology in Sri Lanka.

The agreement was signed by Russian Atomic Energy Agency, Rosatom Head and former Russian Prime Minister Sergey Kiriyenko and Sri Lanka Atomic Energy Authority Chairman Dr Ranjith Wijewardena on behalf of the two states.

The agreement facilitates research, studies and specialised training on nuclear energy and nuclear waste management in Sri Lanka with the assistance of Russian specialists on the subject.

The two states have given attention to five key areas centering on nuclear research. Dr Wijewardena said this agreement will help strengthen development related activities in many spheres with the incorporation of nuclear technology and to test the veracity of technological activities.

The bilateral agreement was signed as a result of the recent visit of Technology, Research and Atomic Energy Minister Patali Champika Ranawaka to Russia to participate in an International Ministerial Conference on ‘Nuclear Power in the 21st Century’ in Saint Petersburg from June 27-29.

Representatives of 102 countries including ministers and nuclear technology specialists participated in the conference. The minister during the visit held a special discussion with senior officers of the Russian Atomic Energy Agency on the use of nuclear energy in Sri Lanka.

Brilliant Wesley down Trinity

Wesley laid their hands on the President’s Trophy after two earlier attempts had ended in failure, with a brilliant display of running rugby as they doused Trinity’s hopes with an astonishing 34 points (3 goals, 2 tries, 1 penalty) to 21 (1 goal, 1 try 3 penalties) win at the Royal College Sports Complex on Sunday.

The winners were superbly led by skipper Rahul de Silva and to a man, they supported him admirably.

Poor handling by the Trinity defenders presented Wesley with a couple of tries and after that, there was no come-back for the Kandy lads.

Wesley scored as early as in the third minute, when a reverse pass near the line saw prolific number eight Gavin Siegerts go over for an unconverted try. This was followed by good attacking play by Tillekeratne and Pieris, who kept probing the defence.

Trinity skipper Wadood broke through, but was well held by his opposite number, who forced him to err. After Lakvin Gunasekera had made a dangerous run was brought down in the 22, Ratwatte converted a penalty to reduce the deficit.

Off a scrum twenty yards out, center Ryan Weerakoon scored when he received a good pass from fly half Ratwatte. The conversion saw Trinity take the lead 10-8. A penalty by Rahul de Silva and a drop goal by Tharindu Ratwatte saw lemons being taken with full score at 13-8, in Trinity’s favour.

Wesley made the mistate of trying to beat the defenders one on one and found themselves isolated at times.

The floodgates really opened in the second half. The hard-working Siegertsz seemed to touch down, but referee Jamaldeen was not satisfied. No matter, a second later, center Ishaq Jurampathi obliged. The skipper converted and Wesley now led 15-10. Ratwatte cut the deficit to 13-10 with a well taken penalty.

Alahakoon, in fielding a high kick let the ball pop out of his hands and Ishara Madushanka who was nearby, collected and strolled over, almost unopposed. De Silva converted and extended the lead to 22-13.

Another defensive lapse, this time by Wadood and another Trinitian, saw Joel Tillekeratne going over by the corner flag, (27-13).
This was followed by a Ginhagama blunder which provided another golden moment for Wesley. This time, Thisara Maduwantha did the honours, de Silva converted and Wesley had now insulated themselves from defeat by leading 34-16.Trinity scored a consolation try late in the game, but Wesley had done enough to take the title.

Wesley had done the hard yards by knocking out the league champions Dharmaraja in the semi-final. By beating the number two side, Trinity, Wesley put paid to any doubts about their rugby pedigree.Trinity, champions in 2011, and runner-up last year, were thunderstruck by Wesley’s blitz in the second half, and were never in the hunt thereafter.

This was fantastic rugby by a team that probably knew they had it in them to turn up trumps. It was wonderful 15 man rugby and when Wesley’s back division ran with the ball, they provided loads of excitement. (by Our special Sports Corr.)

Rs. 100m for migrant workers’ housing project

The Government has launched the Rataviru Piyasa program to fulfil the housing needs of needy migrant workers and their families. The Government has allocated Rs. 100 million to initiate the program and plans are afoot to build 1,000 houses this year.

The Sri Lanka Bureau of Foreign Employment has made a cash bond with the Samurdhi Bank, enabling migrant worker account holders to apply for soft loans.

Under the program recipients will be provided with special concessionary loans (10 percent interest calculated on reducing balance) to build houses through Samurdhi Banks. The program is a concept of Minister for Foreign Employment and Welfare, Dilan Perera.

In addition, the newly-formed Rataviruwo Organisation, which now has branches in all District Secretariat divisions, will help migrant workers and their families to build houses by offering technical support, labour and other assistance. Rataviruwo, comprises foreign employment authorities, State officials and migrant workers and their families.

Formulated and implemented under the guidance of Minister Perera, the organisation strives to help the country’s labour migrants and families to fulfil their socio-economic needs.

Sri Lanka’s migrant worker fraternity, numbering over 1.7 million, is the country’s largest foreign revenue earner. The annual outflow of migrant workers from the country is around 280,000. (by Ananda Agalakada)

Lankan protesters given bail

A Sri Lankan protester who invaded the pitch during a cricket match between Sri Lanka and India in Cardiff, has been released on conditional bail by a UK court, Wales Online reported.

Manimaran Sadasaramoorthy, 42, of Mitcham in Surrey, travelled to Wales on June 20 this year to take part in a legal protest at the city’s Swalec Stadium against the presence of the Sri Lankan cricket team on British soil.

The team lost to India by eight wickets in the Champions Trophy semi-final.

Pleading guilty to a section five public order offence at Cardiff Magistrates’ Court, the unemployed dad of two told Judge Martin Brown that he ran on the pitch during the match carrying a banner “for the 40,000 people killed by the Sri Lankan government” and a Tamil Eelam flag of a proposed independent state that Tamils in Sri Lanka want to create in the north and east of the country.

The largely peaceful protests in Cardiff followed a violent incident near the Oval Stadium in London the same week, where Tamil and Sinhala activists clashed during the Sri Lanka-Australia cricket match.

Sadasaramoorthy was accused alongside six other protesters, who all pleaded not guilty to the offence and were bailed with the condition that they cannot attend any national or international cricket matches until their trial in September.

An eighth man admitted throwing a stone at a passing car outside the stadium, while a ninth man accused of common assault was unable to submit a plea because he could not understand the Tamil interpreter provided by the court – his case was adjourned until July 23.

Prosecutor David Cooke told the court Sadasaramoorthy gave a false name and date of birth on his arrest and was later found to have “previous convictions for dishonesty”, Cooke said, the last of which was in 2006.

Asked by Judge Brown why he ran onto the pitch, Sadasaramoorthy – who was representing himself – said: “My dad lived in Sri Lanka in the north east and in 2009 the Sri Lankan government declared a war – my father was arrested and they murdered him.”

Saying he was aware the ethnic Tamils had a “grievance” against the Sri Lankan government, Judge Brown asked him to instead explain why he ran onto the pitch on June 20.

Sadasaramoorthy answered: “On the day I went a lot of Sri Lankans were shouting ‘you can never come back to Sri Lanka’, saying if you come there they would kill me, so I told them you are in a democratic country in Britain and that they couldn’t do anything here.

“That’s why I took the flag and ran on to the pitch.”

The judge gave him seven days to pay a £250 fine, £85 court costs and a £25 victim surcharge “in it’s entirety”. Six other defendants who denied public order offences were Regan Chares Kumar Balachandran, 23, of Newham, London, Sukitharshan Karthikesu, 25, of Buckhurst Hill, Essex, Thilakshan Kulasingam, 19, of Mitcham, Surrey, Kaunshanth Maheswaran, 20, of Dartford, Kent, Sivendran Nadarajah, 24, of Mitcham, Surrey and Thayalan Ratnam, 31, of Croydon.

Ranil wants Govt. to establish ICs before Northern PC polls

UNP leader Ranil Wickremesinghe yesterday called on the government to re-establish all the Independent Commissions (ICs) for the Elections, Police and Judicial Service etc before holding the Northern, North-Western and Central Provincial Council Polls, which have been scheduled for September.

He told the media in Colombo that Sri Lanka was a signatory to the Universal Declaration of Human Rights, which required that the will of the people shall be expressed in periodic and genuine elections, by universal and equal suffrage, secret vote or by equivalent free voting procedures.

The Rajapaksa regime had to re-introduce the 17th Amendment to the Constitution.

An independent public service, which could act without political interference, he said was a sine que non to ending the violence and vote rigging that had marred successive elections under the current government.

The UNP leader observed that he had already written to President Mahinda Rajapaksa urging him to re-introduce 17-A and expected him to display his commitment to the conduct of democratic polls.

Instead of adopting time wasting tactics through the establishment of Parliamentary Select Committees, to discuss issues which have been debated for years, the priority was to introduce an urgent bill that could free the public service from its shackles, he pointed out. (by Zacki Jabbar)

Lankans aim success against nemesis, Sri Lanka vs India Tri-series final

A rejuvenated India will be aiming for yet another title triumph when they clash with Sri Lanka in the final of the Celcon Mobile Cup tri-nation ODI series today, Thursday.

The reigning ICC World Cup and Champions Trophy winners, India have the edge as they have lost only seven of the last 20 ODIs played between the two countries. The tri-series final today will be the third final of such major tournaments the two neighbouring countries are meeting in recent times.

Hosts West Indies will be mere observers of the final, taking place at Queen’s Park Oval, Port-of-Spain, Trinidad.

After their campaign was in tatters, following their back-to-back defeats in the first leg of the tournament, the Indians fought back with two bonus-point wins to cruise into the final, at the expense of the West Indies.

Despite the absence of Dhoni, who was ruled out after the loss to West Indies in their series opener, stand-in skipper Virat Kohli successfully led the Indians to the final.

India entered the final as table-toppers having posted two wins from four matches. Other two teams too have a similar record but India have the advantage of enjoying a better net run-rate.

The Indian team composition for the final will most likely be the same.

The Sri Lankans will once again look to old guards Mahela Jayawardene and Kumar Sangakkara for success against a team that has been their nemesis in recent times.

India’s batting wears a formidable look with the in-form Shikhar Dhawan and Rohit Sharma opening the innings. Kohli is the pivot around which the Indian batting revolves.

Then there is Dinesh Karthik, Suresh Raina with rising all-rounder Ravindra Jadeja completing the batting line-up. And in the event of Dhoni returning to the playing XI, it will only strengthen their batting.

In the bowling department, India’s young bowlers excelled and were largely responsible for setting up victories in the last two matches.

22-year-old seamer Bhuvneshwar Kumar, who produced a career-best spell of 4 for 8 in a devastating exhibition of swing bowling against the Lankans on Tuesday, deserves special mention. The leading wicket-taker in the series with eight scalps from three games, Kumar’s performance in Tuesday’s game is the best by an Indian bowler in the West Indies in ODIs, bettering Amit Mishra’s four for 31 at the same venue in 2011.

As far as the Sri Lankans are concerned, they will have to shore up the batting after the lackluster display against India when they were bundled out for 96 in 24.4 overs while chasing 178 in 26 overs, under the Duckworth-Lewis Method in yet another rain-hit match.

It will take a lot of doing from the likes of Upul Tharanga, Dinesh Chandimal, Lahiru Thirimanne and skipper Angelo Mathews to outdo the in-form Indian seamers.

Another factor that works in India’s favour is that they have won four consecutive ODIs on this venue over the last two years.

Regarding Dhoni, he had done a bit of running ahead of their match against Sri Lanka on Tuesday and Kohli had said at the toss that Dhoni could be ready to play the final.

Magistrate chides British HC over request

While rejecting a request made through the police by the British High Commission in Colombo to get a Briton’s passport released from court custody, the Colombo Fort Magistrate yesterday observed that he does not hear cases according to the wants of the British High Commission.

The Britisher in question had been charged with the non-payment of a hotel bill.

Magistrate Thilina Gamage observed that Courts functioned in accordance with rules and regulations and maintained that it was not for the British High Commission, but the owner of the passport to come to Court and make a request for its release.

Grand Oriental Hotel (GOH) Manager had in a complaint to the Fort police alleged that the Birtisher Allen John had defaulted on a payment of Rs.17,202 after using the hotel’s facilities. He had stayed in the hotel on April 4, 2013 and had reportedly left on the following day without paying the bill. However, the suspect had failed to carry his travel documents including the passport with him.

Subsequently, the hotel management had lodged a complaint with police after handing over the suspect’s passport to the police. Police who conducted investigations had informed the British High Commission. It was revealed that the British High Commission had paid the hotel bill owed by the Britisher. Subsequently, the complainant had informed police that they were willing to settle the matter since the bill had been already settled by the High Commission.

Filing a motion before Magistrate Thilina Gamage, the Fort police yesterday informed Court that the British High Commission had sent them a letter requesting to get the suspect’s passport released since he was to be sent back. In this instance, the Magistrate rejected the British High Commission’s move to have the passport released without following the proper legal procedure. (Lakmal Sooriyagoda)

Whale sends Sri Lankan born surfer flying through the air with a flick of its tail off bondi Beach

A man is recovering after being knocked unconscious by a giant whale while surfing off Bondi Beach in Australia.

Dr Bishan Rajapakse, 38, said he spotted the whale “the size of a minibus” approaching him and the next thing he knew was waking up on the shore after being rescued by lifesavers.

The medic, who lives in Sydney, was taken to hospital and treated for head and shoulder injuries. Witnesses reported seeing his surf board being hurled three metres into the after he was hit by the mammal, believed to be a southern white whale.

Extortion scandal rocks Sri Lanka Cricket

A major scandal shook Sri Lanka Cricket as a top cricket official was investigated last week for alleged extortion of money from Sri Lanka women’s cricketers.

Sri Lanka women’s cricket team manager A.R.M. Aroos admitted yesterday that he has accepted money from Sri Lanka women’s captain Shashikala Siriwardena but brushed it off as a goodwill gesture on her part some months back and questioned the motive of bringing the issue up after several months.

“She came with her husband and gave me some money. I have money and I didn’t take any serious note of it. But my question is why bring it up now. Sri Lanka women’s coach Harsha de Silva has drafted a letter and has asked her to implicate me. It was nothing serious” said Aroos and said the matter is now closed as the inquiry is completed.

Sri Lanka Cricket (SLC) appointed retired police SSP Hema de Silva for an immediate inquiry after Siriwardena had made an official complaint on the issue to SLC acting Chief executive Ashley de Silva last week.

Aroos has been a prominent SLC officials for nearly two decades and is also serving presently as a national selector for women’s cricket.

“We appointed a one-man inquiry committee to investigate some serious allegations. We will get the report in two days. Till then we cannot disclose anything” said de Silva.

The one-man committee concluded his inquiry yesterday and is due to submit a report today while SLC has summoned an urgent Ex-co meeting tomorrow to discuss the report and take action on it.

Aroos said that Siriwardena and Sri Lanka star Lasith Malinga were chosen as brand ambassadors by the ICC for last year’s ICC World T20 tournament hosted by Sri Lanka. ICC had offered US $ 2500 to Siriwardena to act as the brand ambassador for the event, but SLC had negotiated successfully increase it to US $ 5000 which she had received in five monthly installments prior to the ICC World T20 tournament held in September and October last year.

Aroos said that Siriwardena had volunteered to make a ten percent commission of her payment as she was happy that SLC had managed to get a hundred percent increase on her payment from ICC and he accepted it without giving much thought to it.

However, sources told “Daily Mirror” that Siriwardena in her written complaint had alleged that Aroos demanded a commission.

“There were several officials including SLC Secretary Nishantha Ranatunga present when I once told her jokingly that she ought to give me a ten percent commission for getting an increase in her payment. She said that I actually deserved it and she wouldn’t mind giving me even a bigger commission. It was all in the spirit” said Aroos.

Aroos alleged that Siriwardena came up with her complaint several months after the actual incident as she was under the impression that he had been blocking a subsequent sponsorship deal she had struck with Sri Lanka national team sponsor Dialog for the want of another commission.

“Dialog wanted to sign a sponsorship agreement with five players. But Vanessa (women’s cricket co-ordinator Vanessa de Silva) told me that the players have to get permission from SLC to sign it. When I asked SLC head of marketing Vajira Dassanayake, he said that the players did not need such permission. So, I went with the players and signed the agreement. But later SLC CEO Ashley de Silva told me that players have to submit a letter to seek SLC permission for such a deal” Aroos said.
“However it is two months since they signed this agreement and nothing has happened. They were under the impression that I was stopping it. That is what happened. I gave my statement at the inquiry and it is all finished now” said Aroos.

According to sources, Siriwardena had alleged that Aroos also implicated former SLC Chief Executive Ajit Jayasekara saying that he needed to give a share to Jayasekara as well, but added that Aroos had denied it in his statement at the inquiry on Saturday.

Siriwardena was not available for comment yesterday.

No ICC events for Sri Lanka for ten years

Sri Lankan cricket enthusiasts were in for a rude shock yesterday after it was revealed that the country will not be hosting any ICC events for the next ten years!

The ICC announced yesterday its global events from the period of 2016 to 2023 and while all Full Members of ICC were given some event, the only countries that were not allocated any events were Sri Lanka and Pakistan. While no cricket has been taking place in Pakistan since 2009 due to security concerns, it was surprising to see Sri Lanka being completely left out– not even an under-19 World Cup or a Women’s World Cup.

Several of Sri Lanka Cricket (SLC) officials were unaware about the development yesterday while certain others played clever political games by distancing themselves from the development, but the fact remains that the political henchmen of SLC will have to answer some tough questions over the next few weeks.

Sri Lanka were represented by Jayantha Dharmadasa and Nishantha Ranatunga at the recent ICC meetings in England. While Dharmadasa attended the ICC Board Meeting, Ranatunga attended the ICC Chief Executives’ Meeting, although he is not the CEO of the board.

The World T-20 and the World Cup that Sri Lanka hosted in 2012 and 2011 were hugely popular among Sri Lankan fans and those events also helped the country to upgrade cricket infrastructure. Into the bargain, the events also were a boost for tourism in the country.

England and India have got the major share of next few ICC events with the Board of Control for Cricket in India getting a World Cup, a World T-20 and a World Test Championship, ECB got the opportunity to host the inaugural Test Championship in 2017 and the ICC World Cup in 2019.

Since 2000, Sri Lanka has become a favourite destination for ICC events. Sri Lanka hosted the World T-20 last year and were co-hosts of the ICC World Cup in 2011 alongside India, Pakistan and Bangladesh. The country also hosted the ICC Champions Trophy in 2002 and the ICC Under-19 World Cups in 2000 and 2006.
